The council is not required to prune or fell a council owned tree to allow your building works to proceed whether planning consent was necessary or via permitted development. Advice: If you wish to exercise your Common Law right to remove the nuisance associated with encroaching trees – see previous advice. (Section 4) |

Trees and development |
Tree will be considered as a material consideration in relation to a development and must be considered in accordance to BS 5837 (2012) Trees in relation to design, demolition and construction. Advice: If there are trees established within a site proposed for development, they are required to be considered within an Arboricultural Implications Assessment in line with BS5837. The assessment must be carried out by an individual qualified and experienced in arboriculture and development. Where trees are agreed to be removed as part of an approved development, the applicant will be required to submit a landscape plan with mitigation for the trees removed. |
